It’s far from over. 90 Day Fiancé star Ashley Smith (née Martson) will be spending her holiday weekend surrounded by loved ones, amid her estranged husband’s ongoing legal drama. As In Touch previously confirmed, Jay Smith (real name: Conroy St. Christopher Smith), was taken into ICE custody on the morning of Wednesday, July 3, and is currently facing deportation.

“Jay remains in custody as the deportation process can take 6-8 months,” according to the new statement provided to In Touch from Jay and Ashley’s representative. “Ashley is in New York and is going to take the 4th of July holiday to focus on herself and her kids, and just try not to worry about it. They’ll both be in court on Tuesday [July 9] and Wednesday [July 10].”

The 21-year-old Jamaica native turned himself into authorities on July 3 after finding out that he had a warrant out for his arrest, following an alleged violation of a PFA (Protection From Abuse) order that was placed against him by Ashley, 31. Jay is currently being detained in York County Prison in Pennsylvania, ICE (Immigration and Customs Enforcement) records confirm.

On July 2, Upper Allen Police investigated a report of a PFA violation following a social media post made by Jay. As a result of the investigation, an arrest warrant was obtained and he was taken into custody without incident the following day. Jay was transported to the Cumberland County Prison for processing and arraignment with a hearing scheduled for a later date.

Hours before he was detained, Jay posted a cryptic video to his Instagram Story showing the lyrics from Lil Durk’s single called “Turn Myself In.” It’s unclear if this is the social media post referred to.

In the wake of Jay’s deportation drama, Ashley also posted another message to her Instagram Stories this afternoon. “Due to the current situation, I have to cancel my appearance in Jamaica next week,” the mother-of-two wrote. “I genuinely apologize to everyone that was expecting to meet me and to @worldrunners_travel for offering me such an amazing vacation.” The reality star later shared a video of herself spending time outside by the pool.

The exes have faced no shortage of turmoil over the course of their relationship. Ashley filed for divorce for the second time in April 2019, and she recently discovered he was unfaithful again on the tense June 23 episode of the spinoff, 90 Day Fiancé: Happily Ever After?

Jay still has a chance to appeal, but if Ashley provides “evidence” that he used her for a green card, then there’s a strong likelihood that he’ll be sent back to Jamaica.
