Family History
Olivia first gained sole custody of Kaden on September 12, 2014, when her son with David, 31, was only 10 months old. At the time, the father of three was also given a no contact order.

Legal Protection
“The Defendant [David] has committed acts of domestic violence on the Plaintiff [Olivia] during the course of the relationship,” the documents state, claiming he had also “endangered the life of the child.”

Aggressive Behavior
According to the paperwork, David was accused of “pushing Plaintiff when she was eight months pregnant and … leaving her in the middle of the road at night when she was seven months pregnant.”

Change of Plans
Things changed for the family in January 2017. A new custody agreement allowed the father to have contact with his son on an “incremental basis,” graduating to every other weekend by January 2018.

Acting Out
However, the paperwork claims that by July 2018, the now 5-year-old “began displaying a series of alarming behaviors related to visitation with the Defendant.”

Negative Reaction
“He would cry uncontrollably, … he would beg not to visit Defendant and … he was evasive about why he did not want to visit Defendant at Defendant’s residence,” the documents state.

New Deal
In November 2018, the courts revoked the custody agreement in place, suspending David’s visitation rights. The decision came not long after Jenelle Evans was hospitalized after “tripping” at their home.

Citing Proof
According to Radar, in her June petition for custody, Olivia mentioned the 911 call Jenelle, 27, made at the time she “tripped,” during which she accused David of assaulting her.

In Danger
On the call, Jenelle can be heard saying, “I have four kids at the house with me right now, and they’re all sleeping. I don’t know. I don’t know what to do.” One of those kids was allegedly Kaden.

Making Threats
Olivia also referenced the gun rant David went on after he was visited by the Secret Service. In the Instagram videos he shared, the star showed off a stash of ammo and weapons and fired a gun.

Plenty of Proof
“The court finds this video disturbing and creates safety issues that the Court deems credible,” the documents read. Though David was allowed to Skype with Kaden, the paperwork claims he “did not take full advantage of even the limited amount of time he has been allowed.”

“Since the entry of the February 6, 2018 Custody Order there has been a substantial change in circumstances affecting the welfare of the minor child,” read the docs.

“It is in the best interest of the minor child that Plaintiff shall have sole legal and physical custody of the parties’ minor child.” David won’t be totally out of touch with his son, though.

The custody agreement states that he’ll still be able to Skype with Kaden twice a week — though whether or not David will “not take full advantage” as he did before is undetermined.

Ongoing Battle
However, it’s not over. The custody agreement will be revisited in eight months, at which time visitation with David may be back on the table. Now, Olivia is preparing to fight that.

In Need of Help
However, Olivia’s attorney apparently quit on August 23, 2019 — which is why she started her GoFundMe in order to raise money to hire a new lawyer. “I don’t have the means to keep going alone financially within the court system,” she said.

Back and Forth
That’s where the drama comes into play as Jenelle has responded to her husband’s ex’s GoFundMe by accusing Olivia of being an “alcoholic, cheater, drug addict, scam artist and spouse abuser.” Though Olivia met her fundraising goal and David’s own GoFundMe was shut down, it’s clear the drama is far from over.
